Yayasan Kul-Kul/Green School Bali (“we”, “us”, “YKK” or “GSB”) takes your privacy seriously.  As educators, we know the importance of trust.  We have created this Privacy Policy so you can understand how we collect, process, use, store, share, transfer and otherwise disclose any Personal Data (see definition below) which you provide to us via this Website..

This Privacy Policy is applicable to the official website of YKK (https://www.greenschool.org/bali/) (“Website”).  Please read carefully and understand this Privacy Policy before you start to use our services.  By clicking the button “I have read and agree to the Privacy Policy” and/or using the Website and the functions of the Website, such as filling in online forms, you indicate that you fully understand and agree to the terms of this Privacy Policy and agree to authorise us to collect, process, use, store, share, transfer and otherwise disclose Personal Data that you provide to us within the scope of this Privacy Policy. Please discontinue use of the Website if you do not agree to any terms contained in this Privacy Policy.

Please make sure that you have the authority and full legal capacity for civil conduct to use the Website, to submit Personal Data as requested via the Website, and to authorise us to collect, process, use, store, share, transfer or otherwise disclose the Personal Data within the scope as described in this Privacy Policy. Under this Privacy Policy, the applicable data protection , Government Regulation No. 71 of 2019 on the Organisation of Electronic Systems and Transactions (“GR 71/2019”), and Regulation of the Minister of Communication and Informatics of the Republic of Indonesia  No. 20 of 2016 on Personal Data Protection in Electronic Systems (“MOCI Regulation 20/2016”). This Privacy Policy also refers to relevant provisions of Law No. 11 of 2008 as amended by Law No 19 of 2016 on Electronic Information and Transactions (“EIT Law”).

PLEASE NOTE that there may be changes to this Privacy Policy from time to time, which will be posted on the Website.  We will remind you of such changes through website announcements or by other reasonable means before such changes take effect.  The revised Privacy Policy will replace the prior version of the Privacy Policy and will be legally effective on the date specified in the revised Privacy Policy. Without your consent, we will not reduce your rights under this Privacy Policy. If you do not agree to any of the revised terms, please discontinue the use of the Website before the revised Privacy Policy takes effect.

Personal Data Protection

All Personal Data is treated in strict confidence and is processed in accordance with applicable laws and regulations.

We will provide corresponding security measures according to existing technology to protect Personal Data and provide a reasonable assurance of security. We will endeavour to protect Personal Data from unauthorised access, disclosure, use, destruction, loss or divulgence. Should these events occur, we will notify you within 72 hours. • When you send enquiries about YKK to us via the Website;
• When you subscribe for newsletters and other information about YKK;
• When you or your child applies to enrol at YKK via our online portal;
• When you request to schedule an open day or tour of YKK; and
• When you or your child applies to any activity held in conjunction with or organised by YKK.

If you do not disclose your Personal Data, we may not be able to provide you with our services which you have requested.

“Personal Data” means data, regarding individuals who are identified or can be identified separately or in combination with other information, either directly or indirectly through an electronic or non-electronic system.

Personal Data Storage

In principle, all Personal Data will be stored within the legal jurisdiction in which it is collected. We may, however, provide services to you via resources and servers outside of your jurisdiction of residence and, due to Green School International’s global operating and management requirements, we may transfer and store your Personal Data outside of your jurisdiction of residence with members of Green School International globally and its Recipients (defined below) to the extent permitted under applicable law.

We will continue to retain Personal Data that we collect for as long as is reasonably necessary to fulfil the original purpose of collection and as may be required under applicable law or business purposes.

Use and Disclosure of Personal Data

1. Purposes

The purpose for which Personal Data is collected and processed includes, but is not limited to the following:

• To manage the relationship with you and your child (e.g. to respond to your queries);
• To process applications for admission;
• To facilitate YKK related events (e.g. open day or visit to YKK);
• To comply with any regulatory, audit or security related requirements;
• To send you direct marketing relating to YKK (e.g. newsletters and advertisements regarding YKK); and
• Any other purposes related to the smooth running of YKK.

2. Sharing and Transfer of Personal Data

In order to fulfil the purposes described in this Privacy Policy and to serve you, we may share Personal Data with group companies, where applicable, including the EiM Group and other Recipients (defined below) which are located in the United Kingdom, United States, Singapore, China (including Hong Kong, Macao and Taiwan), Republic of Korea, Switzerland, Mexico, South Africa, New Zealand and other jurisdictions in which the Recipients have operations. We will only share and transfer Personal Data as is necessary, as subject to this Privacy Policy and will require these Recipients provide such Personal Data a standard of protection that is at least comparable to that under the PDP Law.

Such overseas personal data transfer will comply with all local regulations and requirements.

“Recipients” may include but are not limited to: educational institutions, educational service providers, performing arts institutions, arts organisations, sport organisations, professionals (individuals as well as organisations) involved in teaching and learning at YKK, data analysis service providers, advertising service providers, product suppliers and service providers which YKK may inform you of.

3. Non-identifiable Personal Data

We may gather statistics with respect to academic performance and applications for admission and share with members of the EiM Group or other institutions or publicly disclose such statistics and analytical data, for the purpose of analysing the operations of YKK or EiM Group. Such data will not consist of any Personal Data.

Save as permissible above, we will only disclose your Personal Data to third parties or the public with your consent or based on applicable laws and regulations.

Managing Your Personal Data

If you wish to access or modify your Personal Data eg in the event of errors or inaccuracies, or to request us to delete your Personal Data in accordance with provisions of applicable laws and regulations, you can reach us via the contact information in this Privacy Policy to access, modify or delete your Personal Data. We may require you to provide proof of identification to verify you have the right to make such a request.

If you wish to change or withdraw your consent regarding Personal Data collection and use, you may reach us via the contact information in this Privacy Policy. We may require you to provide a necessary proof of identification to verify you have the right to make such a request. After you have notified us of your decision to withdraw consent, we will stop processing and erase your Personal Data. 

We may decline your requests if the laws and regulations require us to do so. For some requests, additional time may be needed to process your request. Even if we delete your child’s Personal Data upon your request or you successfully withdraw your consent, we still have the right to retain and use anonymized data that we have collected based on your earlier consent. Such anonymized data will not be personally identifiable.
